These Terms of Service ("Terms") govern your access to and use of the PineScripter website and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
PineScripter is a code generation tool that provides an AI-assisted environment to help users draft, refine, and understand TradingView Pine Script (v5 and v6) code. Outputs may include code snippets, explanations, and suggestions.
PineScripter is a Developer Tool and Code Compiler, NOT a Financial Advisor or Investment Advisor.
The Service translates your trading logic and strategy descriptions into executable Pine Script code. You are the sole author of the strategy logic; PineScripter merely converts your instructions into code syntax. The Service is provided for informational and educational purposes only and does not constitute investment, financial, or trading advice. We do not recommend, endorse, or guarantee the profitability of any trading strategy or code generated through the Service.
The Service is NOT available to residents of India.
By accessing or using the Service, you represent and warrant that you are not located in, under the control of, or a national or resident of India. We employ geo-fencing technology to block access from this jurisdiction.
Any attempt to circumvent geographic restrictions, including through the use of VPNs, proxy servers, or other methods, is strictly prohibited and constitutes a material breach of these Terms. Any account found to be accessing the Service from India, or attempting to circumvent geographic restrictions, will be terminated immediately without notice or refund.
We reserve the right to expand or modify geographic restrictions at any time to ensure compliance with applicable laws and regulations.
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must not be a resident of or located in India to create an account or use the Service.
New accounts may receive a limited, non-transferable free trial (e.g., one free request) solely for evaluating the Service. We reserve the right to modify, limit, or terminate free trials at any time without notice. Usage limits may apply to all plans to protect system integrity and fair use.
Paid plans (when available) may be offered on a subscription basis. Prices, features, and limits are subject to change. By subscribing, you authorize us and our payment processor to charge applicable fees and taxes. Unless otherwise stated, subscriptions renew automatically until canceled. You may cancel at any time; cancellations take effect at the end of the current billing period. Fees are generally non-refundable except as required by law.
Payment Currency Restrictions: The Service does NOT accept payments in Indian Rupees (INR). All payments must be made in USD, EUR, or other supported international currencies as displayed at checkout.
This restriction is in place to ensure compliance with export regulations and to maintain the Service's international nature. Any attempt to make payments in INR or from Indian payment methods will be declined.
You retain ownership of content you submit to the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, process, display, and use the content solely to provide and improve the Service.
You are the sole author of all trading strategy logic and decisions. PineScripter merely translates your instructions into code syntax.
AI-generated outputs may be similar to content generated for other users. We do not claim ownership over your specific outputs; however, we may store outputs for quality, safety, and product improvement unless you opt out where available. You are solely responsible for verifying and using outputs safely and lawfully. Any trading decisions, strategy parameters, or logic implemented in the generated code are your sole responsibility.
The Service, including all software, UI, branding, and content (excluding User Content), is owned by PineScripter and its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works except as expressly permitted by these Terms.
We may integrate third-party services (e.g., authentication, analytics, payment, hosting). Your use of those services may be subject to additional terms and policies from those providers.
To the fullest extent permitted by law, PineScripter and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenues, data, or business opportunities, arising from or related to your use of the Service, even if advised of the possibility of such damages. Our aggregate liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the event giving rise to the claim, or ten (10) USD if you have not paid for the Service.
You agree to indemnify and hold PineScripter harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your infringement of any third-party right.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or pose a risk to the Service or other users. Upon termination, your right to use the Service ceases immediately.
Accounts found to be accessing the Service from India, or attempting to circumvent geographic restrictions, will be terminated immediately without notice or refund.
We may modify or discontinue the Service (in whole or part) at any time. We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Your continued use after changes become effective constitutes acceptance of the revised Terms.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and PineScripter agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (collectively, "Disputes") will be resolved through binding individual arbitration rather than in court, except that either party may seek injunctive or other equitable relief in court for infringement or misuse of intellectual property rights.
Arbitration shall be conducted by a single arbitrator under the rules of the Indian Council of Arbitration or another mutually agreed arbitration body. The arbitration shall take place in Uttar Pradesh, India, or remotely via video conference at the arbitrator's discretion. The language of arbitration shall be English. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Each party shall bear its own costs and fees associated with the arbitration, except that PineScripter will pay arbitration filing fees for claims under $1,000 USD if you can demonstrate financial hardship.
YOU AND PINESCRIPTER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
Unless both you and PineScripter agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative, class, or collective proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration section shall be null and void, and the dispute shall proceed in court.
PineScripter shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics or pandemics, strikes, power outages, internet or telecommunications failures, cyberattacks, or failures of third-party service providers (including AI model providers, cloud hosting, and payment processors).
In the event of a force majeure, our obligations shall be suspended for the duration of the event, and we shall use reasonable efforts to resume performance as soon as practicable.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and all remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and PineScripter regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
These Terms are governed by the laws of India, and to the extent applicable, the laws of the State of Uttar Pradesh, without regard to its conflict of laws principles. Subject to the arbitration provisions above, you agree to the exclusive jurisdiction of courts located in Uttar Pradesh, India for any disputes not subject to arbitration.
