These Terms of Service ("Terms") govern your access to and use of the PineScripter website and services (collectively, the "Service"). By accessing or using the Service, by clicking to accept these Terms (including any checkbox presented during sign-up), or by otherwise indicating your acceptance, you agree to be bound by these Terms and by our Privacy Policy and Disclaimer, which are incorporated here by reference. If you do not agree, do not access or use the Service.
PineScripter is a code generation tool that provides an AI-assisted environment to help users draft, refine, and understand TradingView Pine Script (v5 and v6) code. Outputs may include code snippets, explanations, and suggestions.
PineScripter is a Developer Tool and Code Generator, NOT a Financial Advisor or Investment Advisor.
The Service translates your trading logic and strategy descriptions into Pine Script code. You are the sole author of the strategy logic; PineScripter merely converts your instructions into code syntax. The Service is provided for educational and informational purposes only and does not constitute investment, financial, or trading advice. We do not recommend, endorse, or guarantee the profitability of any trading strategy or code generated through the Service.
No Professional Advice; Assumption of Risk.
Nothing on the Service is, or should be construed as, financial, investment, tax, legal, or other professional advice. PineScripter is powered by third-party AI large language models, which can produce output that is incomplete, inaccurate, or that does not perform as you intend. You acknowledge and agree that trading and investing involve substantial risk of loss, that you may lose some or all of your capital, that past performance and backtest results are not indicative of future results, and that you use any code generated through the Service entirely at your own risk. You are solely responsible for reviewing, testing, and validating all code before relying on it, and for any decisions you make and any outcomes that result. You should consult a qualified, licensed professional before making any financial decision.
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You are responsible for ensuring that your use of the Service is permitted under the laws and regulations that apply to you.
Usage limits may apply to all plans to protect system integrity and fair use. We reserve the right to modify plan features, limits, or pricing at any time without notice.
Paid plans (when available) may be offered on a subscription basis. Prices, features, and limits are subject to change. By subscribing, you authorize us and our payment processor to charge applicable fees and taxes. Unless otherwise stated, subscriptions renew automatically until canceled. You may cancel at any time; cancellations take effect at the end of the current billing period. Fees are generally non-refundable except as required by law or as described in our Refund Policy.
You retain ownership of content you submit to the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, process, display, and use the content solely to provide and improve the Service.
You are the sole author of all trading strategy logic and decisions. PineScripter merely translates your instructions into code syntax.
AI-generated outputs may be similar to content generated for other users. We do not claim ownership over your specific outputs; however, we may store outputs for quality, safety, and product improvement unless you opt out where available. You are solely responsible for verifying and using outputs safely and lawfully. Any trading decisions, strategy parameters, or logic implemented in the generated code are your sole responsibility.
AI-Generated Explanations Disclaimer:
The Service provides AI-generated plain English explanations of Pine Script code. These explanations are generated automatically and may contain errors, inaccuracies, or incomplete descriptions of what the code actually does. The explanations are provided for educational and informational purposes only and should not be relied upon as the sole source of understanding. You are solely responsible for reviewing and verifying the actual code to ensure it performs as intended. We make no warranties regarding the accuracy, completeness, or reliability of AI-generated explanations.
The Service, including all software, UI, branding, and content (excluding User Content), is owned by PineScripter and its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works except as expressly permitted by these Terms.
We may integrate third-party services (e.g., authentication, analytics, payment, hosting, and AI model providers). Your use of those services may be subject to additional terms and policies from those providers.
THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, such warranties are limited to the minimum extent permitted by applicable law.
To the fullest extent permitted by law, PineScripter and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, revenues, data, goodwill, or business opportunities, arising from or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages. This includes, without limitation, any trading or investment losses or other financial outcomes resulting from code generated through the Service.
To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) ten (10) USD. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you; in that case, our liability is limited to the minimum extent permitted by applicable law.
You agree to indemnify and hold PineScripter harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your infringement of any third-party right.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or pose a risk to the Service or other users. Upon termination, your right to use the Service ceases immediately.
We may modify or discontinue the Service (in whole or part) at any time. We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Your continued use after changes become effective constitutes acceptance of the revised Terms.
PineScripter shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics or pandemics, strikes, power outages, internet or telecommunications failures, cyberattacks, or failures of third-party service providers (including AI model providers, cloud hosting, and payment processors).
In the event of a force majeure, our obligations shall be suspended for the duration of the event, and we shall use reasonable efforts to resume performance as soon as practicable.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and all remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and PineScripter regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have disputes heard by a jury.
Governing Law. These Terms and any dispute or claim arising out of or relating to them or the Service are governed by the laws applicable to PineScripter's place of operation, without regard to conflict-of-laws rules, except to the extent mandatory consumer-protection laws of your country of residence provide you greater protection.
Informal Resolution First. We want to resolve concerns without formal proceedings. Before filing a claim, please contact us through the support widget on our site and give us at least sixty (60) days to resolve the matter informally.
Binding Arbitration. To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally shall be resolved by final and binding individual arbitration, rather than in court, administered under the rules of a recognized arbitration body. Judgment on the award may be entered in any court of competent jurisdiction. This does not prevent either party from seeking injunctive or equitable relief in court for intellectual-property infringement or unauthorized access to the Service.
Class Action and Jury Trial Waiver. To the fullest extent permitted by law, all claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You and PineScripter each waive any right to a jury trial and to participate in a class or representative action.
Severability of This Section. If the class-action waiver or any part of this section is found unenforceable for a particular claim, that claim shall be severed and may proceed in court, while the remainder of this section continues to apply. If you reside in a jurisdiction that does not permit mandatory arbitration or these waivers, this section applies only to the extent permitted by the laws of that jurisdiction.
